Online Retail and Special Order Terms and Conditions of Sale (Terms of Sale)

QPuzzles Pty Ltd is pleased to offer you the opportunity to buy and receive Products from QPuzzles Pty Ltd through the Website on the basis of the following terms:

  • Orders
    1. These T&C's include all / any orders received;
    2. For each Product listed in your order, your order is an offer from you to QPuzzles Pty Ltd to buy that Product from us. A contract for the supply of the Product from us to you will be formed and we have sent you an email order confirmation.
    3. On the purchase of Products from us, you enter into a contract with us under these Terms of Sale in respect of those Products purchased.
    4. We are responsible for the manufacture & dispatching the Products to you / your client under these Terms of Sale.
    5. All accepted orders of Products supersede all previous quotes/estimates that may have been provided to you.
    6. We reserve the right to limit the quantity of Products purchased by you.
  • Information about Products
    1. Due to photographic and screen limitations associated with the representation of Products, some actual Products may differ to a small extent in visual appearance (for example in colour) from the way they appear on the Website.
  • Pricing and payment
    1. You must pay for all online purchases at the time of dispatch with one of the payment methods offered to you.
    2. Purchases over $500 require a deposit of $500 when you place the order, and the balance is payable before the Goods are collected or dispatched. 
    3. The prices of Products, and any delivery or other charges, shown are in Australian dollars, inclusive of GST.
  • Delivery
    1. You will be notified via email once your Products are ready for dispatch.
    2. We are unable to accept liability for delay in delivering Products which are beyond our reasonable control. If the Product has not been delivered within a reasonable time (depending on the nature of the Product and the delivery address), please contact us.
    3. You must ensure there is clear and safe access for delivery. You must ensure there is a person present at the delivery premises who is authorised by you to accept delivery. If there is not, we will endeavour to deliver the Product if safe and appropriate to do so. If the delivery contractor arrives at the designated address but is unable to deliver the Product or considers that it is unsafe or inappropriate to do so, you may be required to pay for re-delivery later.
    4. Some Products may require extra delivery personnel which may incur an additional charge.
  • Title and Risk
    1. Title and risk of loss or damage to Products purchased by you shall pass to you:
      1. if the Product is delivered to you, upon delivery of the Product; or
      2. if you selected Click & Collect, upon collection of the Product.
  • Warranties and liability
    1. All Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement for or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
    2. To assist QPuzzles Pty Ltd in resolving any problems you may experience, please inspect the Product upon taking delivery and report any shortage, discrepancy, defect, wrong specification or similar problem to us as soon as you become aware of it.
  • Order Cancellation
    1. Cancellation of any order (in full or part):
      1. Must be received prior to QPuzzles commencing the production of that order;
      2. You will be responsible and accept the order (in full or part) even if you wanted to cancel that order but were unable to notify QPuzzles early enough to stop production of that order;
  • Refunds and Returns
    1. QPuzzles reserves the right if unable to collect payment for any order wether cancelled or not to sell on its own terms to recover all / any costs associated with that order.
  • Privacy
    1. QPuzzles Pty Ltd collects your personal information to allow us to supply you or your customer with Products and services. You can read more about how we handle your personal information (including marketing and any disclosure to third parties) in the QPuzzles Pty Ltd Privacy Policy. By providing us with this personal information you agree to this policy.
  • Dispute resolution
    1. If you have a complaint, dispute or any other feedback relating to a Product purchased from QPuzzles Pty Ltd, you may submit your complaint to info@qpuzzles.com.au and we will investigate and respond to your complaint.
  • Third Party Services
    1. Where you arrange and book for any third party services through the Website, you contract separately with that third party. QPuzzles Pty Ltd will not be liable for any services provided by a third party.
  • Inconsistency
    1. These Terms of Sale, together with QPuzzles Pty Ltd policies available on the Website apply to the exclusion of all other terms and conditions. In the event of any inconsistency between those documents, these Online Retail Terms and Conditions will take precedence to the extent necessary to resolve that inconsistency.
  • Definitions
    1. QPuzzles Pty Ltd, we, us or our means QPuzzles Pty Ltd Group Limited;
    2. Checkout Summary means the summary of your purchase of Product/s presented to you prior to confirmation / email of your purchase on the Website;
    3. Product means any goods and services available for purchase from QPuzzles Pty Ltd on the Website;
    4. Website means the QPuzzles Pty Ltd website available at www.qpuzzles.com.au
